Vueling Denied Boarding: Oversold Flights and Your Rights
Denied boarding on a Vueling flight to or from Spain? Here's what the airline owes you, and why ground staff at the gate cannot decide your claim.
Vueling is Spanish registered and part of the IAG group, so you are covered in both directions: departing Gatwick, Manchester or Birmingham under UK261, and flying home from Barcelona, Alicante, Malaga or the Canaries under EU261. Its Barcelona base runs very high summer load factors, which is when oversales turn into offloads.
Ground staff do not decide your claim
Vueling uses third party handling agents at many Spanish airports. When a flight is oversold, the person telling you that you cannot board often has no authority over compensation and will tell you to take it up with the airline later. That is not a refusal of your claim, and it does not weaken it. What matters is what you take away from the airport with you.
Before you leave the gate
- Ask for the reason you were refused boarding, in writing or by email
- Photograph your boarding pass and the gate screen showing the time
- Keep the new booking confirmation if you are rerouted
- Keep receipts for food, transport and any hotel, since these are reimbursed separately from compensation
Volunteers first
Vueling has to call for volunteers before bumping anyone. Accepting a voucher or travel credit makes you a volunteer and replaces your statutory entitlement with whatever you agreed. Work out the cash value first, because on a Canaries route the legal figure is well above a typical voucher offer.
How much can you claim?
- £220 or €250 for flights under 1,500km
- £350 or €400 for flights 1,500-3,500km
- £520 or €600 for flights over 3,500km
Gatwick to Barcelona is roughly 1,100km, so mainland Spanish routes usually pay the lowest band. The Canary Islands sit around 2,900km from the UK, which puts Tenerife, Lanzarote and Gran Canaria bumps in the £350 or €400 band. The payment is due on refusal, with no minimum delay to serve.
Care while you wait
On top of compensation, Vueling owes you meals and refreshments appropriate to the wait, two phone calls or emails, and hotel accommodation with transfers if you are held overnight. This applies whether or not compensation is ultimately payable, and it applies immediately rather than after a decision on your claim.
Strikes and weather do not excuse it
Spanish handling and air traffic control strikes are common, and Vueling will often cite them. They are not a defence to denied boarding compensation. The European Court held in Finnair v Lassooy that extraordinary circumstances cannot be used to avoid paying a bumped passenger.
How far back can you claim?
You have 6 years in England, Wales and Northern Ireland, and 5 years in Scotland, so past summer offloads are usually still claimable.
